Different Levels of Sexual Assault

Sexual Assault – This has extremely serious consequences on the life of an accused person. You may face social stigma, financial hardship, and immeasurable stress. Sexual Assault with a Weapon, Threats/Bodily Harm – This is a more severe form of sexual assault, with summary conviction and indictable offenses. 18 month and 10 year max sentences depending on the charge.

Aggravated Sexual Assault – this is always tried as an indictable offense. The minimum jail sentence as a result of conviction is four years.

Under the Criminal Code Section 271 (Revised Statutes of Canada., 1985, c. C-46)

Everyone who commits a sexual assault is guilty of

  • (a) an indictable offence and is liable to imprisonment for a term of not more than 10 years or, if the complainant is under the age of 16 years, to imprisonment for a term of not more than 14 years and to a minimum punishment of imprisonment for a term of one year; or
  • (b) an offence punishable on summary conviction and is liable to imprisonment for a term of not more than 18 months or, if the complainant is under the age of 16 years, to imprisonment for a term of not more than two years less a day and to a minimum punishment of imprisonment for a term of six months.
