Different Levels of Assault
Simple Assault – this can be prosecuted in number of ways. The less severe of these two is simple assault as a summary conviction. With more severe cases, these be able to be treated as an indictable offense. With simple assault, these will typically involve the judge directly (No Jury or Jail Typically). With the more severe cases these do necessitate a formal court proceeding.
Assault Causing Bodily Harm – With regards to notable injuries occurring, this can then be increased to assault causing bodily harm. With a summary conviction it carries a max penalty of 18 months in jail, or, if prosecuted as an indictable offense, it carries a max penalty up to 10 years in prison.
Assault with a Weapon – is a threat or act of violence in which a weapon is used. This can also be prosecuted as either a summary conviction or indictable offense with comparable maximum jail sentences.
Aggravated Assault – at all times this is treated as an indictable offense, with this being one of the more serious charges, it carries a maximum sentence of 14 years in prison.
Assaulting a Police Officer – This can be prosecuted as either a summary conviction or indictable offense, depending on the act.
